PREGGY CHECK TERMS & CONDITIONS
1. INTRODUCTION
These Terms and Conditions (“Terms”) govern your access to and use of PreggyCheck’s™ website, mobile application, content, and digital health services (collectively hereinafter the “Platform”), operated by PreggCheck (“PreggyCheck”, “we”, “our”, or “us”).
By using the Platform, you agree to be bound by these Terms. If you do not agree, you must not access or use the Platform.
2. SCOPE OF SERVICES
PreggyCheck™ provides digital tools and content to support maternal health awareness, wellness tracking, and pregnancy-related insights. The services include, but not limited:
- Symptom tracking and health monitoring tools
- Educational content (non-diagnostic)
- Appointment and reminder functions
- Access to general wellness and mental health resources (e.g., guided meditations, prayers)
- Data sharing and export functionalities for personal records
Important: PreggyCheck™ does not provide medical diagnoses or treatment. All information is for informational purposes only and should not be interpreted as medical advice. Always consult a licensed healthcare professional for medica decisions.
The wellness and mental health content (including prayers and meditation) is not a substitute for professional therapeutic or psychological care. If you are experiencing distress or mental health emergency, please seek help from a qualified provider.
3. USER ELIGIILITY
To use the Platform, you must:
- Be at least 16 years of age (of have parental consent if applicable)
- Not be barred from accessing digital services under applicable laws
- Provide accurate, complete, and updated registration information where required.
4. ACCOUNT SECURITY
You are responsible for maintaining the confidentiality of your login credentials.
You agree to notify us immediately of any unauthorized access or use of your account.
We reserve the right to suspend or terminate any account suspected of unauthorized activity or breach of these Terms.
5. INTELLECTUAL PROPERTY
All content on the Platform, including but not limited to text, graphics, code, logos, icons, and software, is exclusive property of PreggyCheck™ or its licensors and is protected by international copyright, trademark, and intellectual property laws.
You may not:
- Copy, reproduce, or distribute content without written permission
- Reverse engineer, disassemble, or create derivative works of any software
- Use our trademarks without explicit authorization
6. USER-GENERATED CONTENT
Users may voluntarily submit conent such as testimonials, feedback, reviews,
journal entries, or questions. By submitting content, you:
- Grant PreggyCheck™ a worldwide, royalty-free, non-exclusive license to use, reproduce, and publish such content
- Warrant that the content is accurate, not confidential, and does not infringe third-party rights.
You are solely responsible for any content you upload or share. PreggyCheck™ reserves the right to moderate, edit, or remove content at our sole discretion.
By uploading any medical data (e.g., blood pressure logs, test results), you represent that:
- You have the lawful authority to share that information;
- You consent to PreggyCheck™ analysing and displaying interpretations or summaries;
- You understand that such interpretations are not medical diagnoses and may not be accurate.
If you use our “Share Your Journey” feature or export your data, you are responsible for how that data is distributed, used, or further processed outside the Platform.
7. PRIVACY AND DATA PROTECTION
Use of our Platform is also governed by our Global Privacy Policy. We process
your data in accordance with:
- UAE PDPL (Federal Law No. 45 of 2021)
- South Africa POPIA (Act 4 of 2013)
- EU & UK GDPR
- Other applicable regional privacy laws
By using the Platform, you consent to the collection, processing, and transfer of your personal data as outlined in our Global Privacy Policy.
8. ACCEPTABLE USE
You agree not to use the Platform:
- To upload or transmit any content that is unlawful, harmful, or offensive
- To impersonate others or misrepresent your affiliation
- To transmit spam, malware, or other disruptive technologies
- To interfere with or disrupt the security or functionality of the Platform
PreggyCheck™ reserves the right to investigate and take legal action against violations.
9. DISCLAIMERS
- The Platform is provided “as is” and “as available.”
- PreggyCheck™ makes no warranties, express or implied, regarding the accuracy, completeness, or reliability of any information provided.
- We do not warrant uninterrupted or error-free service
- We are not liable for delays or failures due to causes beyond our control (e.g., internet outages, regulatory changes)
- We are not responsible for emotional or psychological outcomes based on the use of our wellness or prayer content.
10. LIMITATION OF LIABILTY
To the fullest extent permitted by law:
- PreggyCheck™ shall not be liable for any indirect, incidental, special, or consequential damages, including health decisions made in reliance on the Platform.
- We are not liable for any unauzthorised use, sharing, or loss of data after it has been exported or shared by the user.
- We are not liable for the accuracy of algorithim-generated interpretations or summaries.
- Our total liability shall not exceed the amount paid by you (if any) in the 12 months preceding the claim.
Some jurisdictions do not allow the exclusion of certain warranties or limitations.
In such cases, PreggyCheck’s™ liability is limited to the maximum extent
permitted by law.
11. THIRD-PARTY LINKS
The Platform may contain links to external websites or applications. We do not endorse or control third-party content and are not responsible for their practices, terms, or policies.
This includes any third-party mediation content, videos, or wellness recommendations accessible via our site.
12. MODIFICATION OF TERMS
We may update these Terms from time to time to reflect changes in law, services, or business practices. We will notify users where required. Continued use of the Platform constitutes acceptance of the revised Terms.
13. TERMINATION
We reserve the right to suspend or terminate access to the Platform at any time, without prior notice, for violations of these Terms or applicable law.
Upon termination, your right to access or use the Platform shall immediately cease.
14. GOVERNING LAW
These Terms are governed by laws of:
- The United Arab Emirates (UAE), where PreggyCheck is incorporated
- Other juristic-specific laws where required (e.g., South Africa, EU)
Disputes shall be resolved through arbitration or competent courts with Dubai, UAE, unless otherwise mandated by applicable law
